2005 Combat Methamphetamine Epidemic Act:

How Retailers Can Comply


 

The Combat Methamphetamine Epidemic Act (CMEA) of 2005 was signed into law in March of 2006 in order to help regulate over-the-counter sales of ephedrine and pseudoephedrine products. These products, in combination with other household goods, can be used to manufacture methamphetamines.

The CMEA requires retailers to:

  • Sets a limit of 3.6 grams per day that the retailer may sell to one customer
  • All products to be kept behind a counter or in a locked cabinet
  • Customers have to show Photo ID for all purchases
  • Keep a purchase log for all purchases containing
    • Name
    • Address
    • Product sold
    • Quantity sold
    • Date and Time of purchase
    • Purchaser's signature
  • Logs must be kept for two (2) years and must be readily available to law enforcement if requested
  • Requires retailers to certify location with the DEA that all employees handling pseudoephedrine or ephedrine sales have been trained in accordance with the CMEA

The transaction limit portion of the CMEA has been in effect since April, however all other parts of the law, including the log and training certification go into effect on September 30th, 2006.
